ACLU-WV Policy Director, Eli Baumwell, spoke at a public hearing against HJR14, HCR33 and HCR61- resolutions that call for a Convention of States under Article V. These resolutions effectively give West Virginia's state vote in favor of opening the U.S. Constitution for written revision. As per Article V in the Constitution, if two-thirds (34) of the states pass similar measures, then a convention is invoked. Many legal scholars from across the political spectrum argue that this untested process risks opening the Constitution up to radical change. We stand unequivocally opposed to such measures and call on the West Virginia Legislature to reject proposals to amend the Constitution under such a method, and to rescind previous standing calls.
